Cancelled / delayed flight

A disrupted air service, such as a cancelled flight and a delayed flight, is not only an inconvenience to travel but also an actual loss of time which, due to its irreversible nature, can only be mitigated by compensation (yes: CJEU in its judgment of 19 November 2009, Joined Cases C-402/07 and C-432/07).

Regulation EC 261/2004, establishing common rules on compensation and assistance to passengers in the event of denied boarding and of cancellation or long delay of flights, fixes the amount of compensation for a cancelled/decelerated flight according to the length of the flight. The amounts of compensation available are EUR 250 for flights of 1500 km or less; EUR 400 for longer flights within the European Union or for other flights of 1500-3500 km; EUR 600 for flights outside the European Union of more than 3500 km.

Our Law Firm has many years of experience in representing passengers in disputes with air carriers in complaint proceedings, the subject of which is compensation for the cancelled flight, and then before the President of the Civil Aviation Office, the Passenger Ombudsman or a common court.

We have favourable decisions in disputes with leading European carriers as well as with airlines having their home airports on other continents.

Cancelled / delayed flight – what we do:

  • analyse the causes and amount of the delay, estimate the amount of compensation,
  • prepare and conduct pre-trial correspondence with the carrier,
  • represent you in court proceedings before common courts in both instances.
