Our Law Firm provides comprehensive advisory services in contracting authorities and contractors at all stages of public procurement, public-private partnership (ppp) and concession procedures.

We provide training for management and executive staff of entrepreneurs and local government units on public procurement.

Public Procurement – what we do:

For Contractors

  • analyse the legal and financial structures of the investment,
  • identify the risk of participation in the public procurement procedure, including those related to the exclusion of the contractor from the procedure,
  • assess the implementation of projects in the light of the Public Procurement Law based on public-private cooperation,
  • develop strategies for participation in public procurement, public-private partnership or concession proceedings,
  • support in identifying and preventing risks related to participation in the public procurement procedure and the performance of the concluded contract,
  • coordinate and support Clients at the stage of the tender procedure (we prepare documentation required in the procedure, questions to the ordering party, answers to the ordering party’s calls),
  • represent our Clients before the National Appeal Chamber and common courts in matters relating to public procurement,
  • advise at the stage of execution of public procurement and public-private partnership contracts (including the admissibility of contract amendments),
  • advise on contracts with subcontractors and other business partners.

For Employers:

  • provide opinions and consultations on public procurement issues,
  • assist in preparing the Terms of Reference (ToR), taking into account the interest and needs of the individual, properties and conditions of the ordered products or services,
  • draw up and give our opinion on a draft contract for public procurement, public-private partnership or concession,
  • prepare and carry out public procurement procedures, including those conducted in negotiation modes, competitive dialogue, innovation partnership, as well as those conducted in the public-private or concession partnership model,
  • audit completed proceedings.
  • represent our Clients before the National Appeal Chamber and common courts in matters relating to public procurement,
  • provide day-to-day service of public procurement,
  • coordinate the proceedings related to the co-financing of an undertaking from public funds or EU funds,
  • provide legal assistance in case of public procurement control, we represent units before the National Appeal Chamber and common courts.
